Niatjo Logistics Limited - Terms and Conditions

By engaging the services of Niatjo Logistics Limited, the shipper and consignee agree to the following terms and conditions. Shipment refers to all documents or parcels that travel under Niatjo Logistics waybill and may be carried by any means, including air, road, sea, or any other carrier as deemed appropriate by Niatjo Logistics.

  1. Liability

Niatjo Logistics’ liability for any shipment is limited to the declared value of the item as shown on the waybill/invoice. For shipments transported by air (including ancillary road transport or stops en route), liability is limited to the value declared by the shipper.

  1. Charges and Billing
  • The charges payable by the shipper for services rendered will be as per Niatjo Logistics’ standard tariffs, which are available upon request.
  • Any shipment not collected within 3 working days of its arrival will incur a daily demurrage charge of [₦500 / applicable fee].
  1. Condition of Goods

The responsibility to prove the quantity, type, and condition of the goods lies with the shipper. The delivery note or any other document provided by Niatjo Logistics does not constitute conclusive proof of the goods’ condition.

  1. Right to Inspection
  • Niatjo Logistics reserves the right to inspect and open goods without prior notice.
  • The receiver must inspect the goods upon delivery and acknowledge their condition. Niatjo Logistics will not be held responsible for complaints made after the goods have left the point of collection.
  1. Deliveries
  • Shipments will be delivered to the receiver’s address provided by the shipper. In cases where delivery cannot be made, Niatjo Logistics will make reasonable efforts to return the shipment at the shipper’s cost or dispose of the shipment without liability.
  • Deliveries will not be made to postal codes but directly to the receiver’s address.
  1. Carrier Lien

Niatjo Logistics has a lien over goods for unpaid charges and reserves the right to retain such goods until complete payment.

  1. Shipper’s Warranties

The shipper warrants that:

  • All Information, values, and descriptions of goods provided are accurate.
  • The goods are the shipper’s property, or the shipper has the authority to ship the goods.
  • The goods are appropriately marked, addressed, and packed for safe transportation.
  • All customs and other applicable regulations are fully complied with.
  1. Dangerous Goods
  • Niatjo Logistics does not accept dangerous, hazardous, or flammable goods for shipment. If such goods are inadvertently accepted, Niatjo Logistics reserves the right to take necessary measures, including disposal, without liability.
  • The shipper is liable for all damages caused by dangerous goods handled by Niatjo Logistics.
  1. Perishable Goods

Perishable goods must be collected immediately upon arrival. If uncollected, they may be disposed of by Niatjo Logistics without notice or liability.

  1. Route

Niatjo Logistics reserves the right to determine the route for transportation of goods.

  1. Carrier’s Obligations

Niatjo Logistics is considered to have fulfilled its obligations once goods are delivered to the address provided or handed over to the receiver or any authorized party.

  1. Carrier Liability for Damage or Loss
  • Niatjo Logistics’ liability is limited to the shipment’s declared value as per the waybill. Liability for indirect or consequential losses, including lost profits or income, is excluded.
  • All claims must be submitted within fourteen (14) days of shipment; otherwise, Niatjo Logistics bears no responsibility.
  1. Subcontracting

Niatjo Logistics may subcontract third parties for services and is not liable for their acts or omissions.

  1. Forfeiture

Shipments unclaimed for over 30 days will be forfeited to Niatjo Logistics and disposed of as appropriate.

  1. Notices

Notices between Niatjo Logistics and the shipper shall be served to the addresses stipulated on the waybill.

  1. Dispute Resolution

Disputes shall first be amicably resolved. The matter will be referred to arbitration under the applicable jurisdiction if not resolved. The laws governing this agreement are those of [insert country].

  1. General Terms
  • These terms represent the entire agreement. Any waiver or modification must be in writing.
  • Niatjo Logistics reserves the right to adjust these terms without prior notice.
  1. Customs Duties and Taxes

The shipper and receiver are responsible for customs duties, taxes, or delays from customs control. Niatjo Logistics will not be held liable for any such charges or delays.

  1. Technical Policy

For shipments involving electronic gadgets, the shipper agrees to test. If testing is declined, Niatjo Logistics is not liable for any damage. Shippers are advised to back up data before shipment.
